Terms of Service

Welcome to OysterPin. By accessing or using our Chrome extension, website (oysterpin.app), and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Your use of the Service is also subject to our Privacy Policy.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service and to agree to these Terms. The Service is not intended for users under 13.

2. Description of Service

OysterPin is a Chrome extension that extracts place information from YouTube videos using AI and syncs them to your personal Google Maps. The Service includes free features (e.g., Quick Scan with daily credits) and paid Credit Packs for advanced features (e.g., AI Vision). You may use credits until they are depleted; credits do not expire.

3. Account and Registration

You sign in using your Google account. You are responsible for maintaining the security of your account and for all activity under it. You must provide accurate information and notify us promptly of any unauthorized use.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Violate the terms of service of YouTube, Google, Gumroad, or any third-party platform the Service integrates with
  • Use the Service for bulk scraping, automated abuse, or to circumvent any technical limitations
  • Resell, redistribute, or commercially exploit extracted place data without authorization
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to infringe any third party's intellectual property or privacy
  • Transmit malware, spam, or illegal content

We reserve the right to suspend or terminate your access if we reasonably believe you have violated these terms.

5. Credit Packs and Payments

  • Purchases: Credit Packs are one-time purchases. Credits are added to your account and used as you consume features. Payments are processed through Gumroad. Use the same email as your OysterPin Google login when purchasing so credits are delivered correctly.
  • Refunds: Credit Pack purchases are non-refundable. If an API error occurs during parsing (e.g., network failure, timeout), we will automatically refund the credits used for that attempt.
  • Credits: Credits do not expire. Advanced features (e.g., Batch Save, Custom Lists) remain available after your first purchase even after credits are depleted.

6. Modifications and Availability

We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any such change. We do not guarantee uninterrupted or error-free operation.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Location Data and Use of Extracted Information

The Service uses artificial intelligence to extract place information from third-party content (e.g., YouTube videos). AI-generated results may contain errors, hallucinations, or misinterpretations. Such information may be incomplete, inaccurate, outdated, or based on unverified sources. We do not warrant the accuracy, availability, safety, or legality of any location or place information provided through the Service.

You are solely responsible for all actions you take based on or after obtaining location information through the Service, including but not limited to visiting places, traveling to locations, relying on the information for navigation or planning, or any other use of the data. We are not liable for any harm, injury, loss, trespass, or other consequence arising from your use of or reliance on such information. You should independently verify any location details (e.g., opening hours, accessibility, safety) before relying on them.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid for the specific Credit Pack or transaction that gave rise to the claim; provided that if no purchase was made in connection with such claim, our liability shall not exceed ten United States dollars (US $10).
  • In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless OysterPin and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Third-Party Services

The Service relies on third parties (e.g., Google, YouTube, Gumroad). We are not responsible for their availability, accuracy, or policies. Your use of those services is subject to their respective terms.

12. Intellectual Property

The Service, including its design, code, and branding, is owned by OysterPin. You may not copy, modify, or distribute any part of the Service without prior written consent. Extracted place data is for your personal use; you retain rights to your own content.

13. Termination

We may terminate or suspend your access at any time for violation of these Terms or for any other reason. Upon termination, your right to use the Service ceases. Provisions that by their nature survive (e.g., liability limitations, indemnification) will remain in effect.

14. Governing Law and Dispute Resolution

In the event of any dispute, the parties shall first attempt to resolve the matter through good-faith negotiations (Amicable Settlement). You agree that before initiating any legal proceedings, you will contact us at [email protected] and allow a period of sixty (60) days for the parties to attempt to resolve the dispute through communication. Legal action may only be pursued if the dispute remains unresolved after this good-faith negotiation period.

These Terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China ("Hong Kong"), without regard to conflict of law principles. If the dispute cannot be resolved through amicable settlement, it shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to changes to third-party APIs or platforms (e.g., Google, YouTube), natural disasters, acts of government, internet or infrastructure outages, cyberattacks, pandemics, or other force majeure events.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
